Já estão valendo as novas regras de proteção dos clientes de operadoras de telefonia, de internet e de TV por assinatura. As empresas tiveram quatro meses para se adaptar às exigências da Agência Nacional de Telecomunicações.

Com as novas regras, resolver o problema do professor de biologia Gilberto Martins de Oliveira parecia simples. Ele questiona uma cobrança e quer cancelar o contrato com uma operadora de telefonia. Falou com a atendente, mas depois de 13 minutos e 54 segundos a ligação caiu.

O novo regulamento diz que, se a ligação cair, a empresa é obrigada a retornar. Para o Gilberto ninguém ligou. “É um descaso com aqueles que são usuários do sistema”, diz o professor.

Outras regras já estão em vigor. O cliente pode cancelar o serviço sem precisar falar com um atendente, apenas acessando a internet ou digitando a opção no menu da central de atendimento da empresa. O prazo para o cancelamento definitivo é de dois dias.
Sempre que questionar o valor de uma cobrança, a resposta deverá ser dada em no máximo 30 dias. No caso dos celulares pré-pagos, a recarga terá validade de no mínimo 30 dias.

Para o advogado Geraldo Tardin, especialista em direito do consumidor, as regras são boas. “Nós esperamos que funcione para evitar justamente a demanda de ações no Judiciário e fazer com que o consumidor não perca tempo em demandar uma coisa que ele tem direito, que é cancelar o seu contrato”, disse.

As regras valem para telefonia fixa, celulares, internet e TV paga. Só no ano passado, a Anatel recebeu 3 milhões de reclamações contra essas prestadoras de serviços e promete punição para quem desrespeitar o regulamento.

“A multa pode chegar a R$ 50 milhões por infração, depende da análise do caso concreto e da gravidade do descumprimento”, disse Elisa Vieira Leonel, superintendente de Relações com os Consumidores da Anatel.
